Buying property in Thailand as a foreigner: your decision checklist

Your nationality, proposed ownership interest and source of funds affect the transaction. The useful first question is not ‘can foreigners buy property?’ but ‘can this buyer acquire this particular right, and what must be evidenced at registration?’

Five statements to resolve before paying

Ask for evidence whenever a proposal relies on a future renewal, nominee shareholders, an access route used by custom, verbal confirmation of condominium quota or a permit still being obtained. For each unresolved point, record the document required, who must supply it and the decision deadline. Have independent counsel connect the acceptable outcome to the payment conditions; an assurance from the selling side should not silently become an assumption in your budget.

Identify the buyer before reserving the property

Decide who will appear on the registered instrument. Buying alone, with a spouse or through an existing business produces different identity, authority and eligibility questions. Give counsel the real facts about nationality, marriage, residence and intended use. A visa or residence arrangement should never be assumed to grant ordinary ownership of Thai land.

Keep passport names consistent across the reservation, banking instructions, translations and final documents. If a name has changed, ask which supporting record and certification the receiving office will accept before sending money.

For a condominium, verify the unit and available quota

Foreign condominium ownership is subject to statutory eligibility and the building's foreign-ownership limit: 49% of the total area of all units, not 49% of the number of apartments. Obtain current confirmation from the condominium juristic person and arrange a transfer-date check. A marketing statement that ‘foreign quota is available’ does not reserve eligibility or establish that the specific unit can transfer to you.

For a villa, separate the building from the land

Ask for a diagram showing who owns the land, who owns the building and which rights give you possession, access and continued use. A purchase agreement for the house cannot itself answer every land question. If a company acquisition is proposed, the scope expands to corporate liabilities, genuine ownership and the lawfulness of the arrangement; a nominee shareholder package is not an acceptable solution.

Agree the funds trail with the bank before remitting

For a purchase relying on imported-funds eligibility, confirm the required remittance currency, beneficiary, purpose wording and bank evidence with the receiving bank and counsel. The correct documents depend on the statutory route; not every foreign buyer uses identical evidence. Save transfer instructions, bank confirmations and the reconciliation to the purchase price. Splitting payments between accounts without a clear plan can make the final evidence harder to assemble.

Plan signatures, translations and a remote closing

If you will not attend, have the intended representative and the receiving Land Office confirm the power-of-attorney requirements in advance. Define the property's references and the permitted actions clearly with counsel. Ask who receives originals, how payment and registration are coordinated and what evidence you receive afterwards. Leave time to correct documents; a flight date or a seller's deadline is not evidence that the file is ready.

Verify before you pay

Tell us about the property and your proposed purchase. The client intake helps establish the checks and service scope needed. Firm availability and timing must be confirmed for your matter.

Questions & answers

Does living in Thailand remove foreign-ownership restrictions?

Do not assume so. Residence, immigration permission and eligibility to acquire a specific property right are separate questions. Have the applicable ownership category confirmed for your own circumstances.

Can my agent confirm everything for me?

An agent can collect documents and coordinate access. Independent legal conclusions require appropriately qualified counsel and relevant official records; the seller's sales representative does not replace that process.
