Koh Samui slope regulations: what a hillside review needs
A hillside plot's elevation, slope and engineering condition are related but different questions. None can be safely reduced to 'the road is steep' or a single number from a property advert. Start with measured site information and the current legal instruments before assessing the design or purchase.
Separate elevation from slope and road gradient
Elevation locates the site vertically against a reference level; slope describes a change in height over distance. The gradient of the approach road may differ from the land where the villa is proposed. Ask a surveyor to identify what was measured, the reference system and the surveyed area. Where a rule uses a specified measurement method, that method must be checked rather than choosing whichever measurement makes a sales proposal look feasible.
Check the current rule before applying a threshold
Samui's environmental notification was replaced in 2025, and the new official text includes altitude-defined zones. This guide deliberately does not turn familiar online slope, height or elevation numbers into universal rules. A planning professional should identify the exact provisions, definitions, map and any transitional rules that affect the parcel and proposal. Ask for that source trail in the assessment so you can distinguish a verified restriction from an unresolved assumption.
Commission a survey that answers the design question
Provide the title and proposed building location, and request relevant contours, boundaries, existing structures, drainage features and access levels. The professional should state the survey date, coverage and limitations. If the seller supplies a survey from before major earthworks, ask whether it still represents current conditions and what historical information is needed. A contour drawing without a clear link to the title parcel may be insufficient for either planning assessment or contract decisions.
Assess stability, drainage and access separately
Even a favourable planning assessment does not establish ground stability or adequate retaining design. Have an engineer determine the appropriate scope for site investigation, cut-and-fill works, retaining structures and stormwater management. Review where discharged water goes and which neighbouring land or shared road may be affected. Ask who owns and maintains any common structures. These are technical and legal interface questions; a scenic view or an existing concrete driveway cannot answer them.
Decide against the intended project, not a generic label
Ask the reviewer to state whether the current evidence supports the proposed concept, requires redesign or leaves material matters unresolved. Keep the planning response, survey and engineering scope together so assumptions can be compared. Before agreeing an unconditional payment, counsel should assess how missing feasibility evidence affects the purchase terms. The outcome may be a further investigation or a different design; a preliminary title scan cannot deliver a hillside buildability certificate.
- Collect the title-linked topographic survey and proposed site plan.
- Ask for current provisions and an explicit measurement method.
- Keep slope rules, ground stability and registered access distinct.
Verify before you pay
Tell us about the property and your proposed purchase. The client intake helps establish the checks and service scope needed. Firm availability and timing must be confirmed for your matter.

Why does this guide not give one maximum slope number?
A purchase decision needs the current provision, its scope and measurement method, and parcel-specific evidence. An isolated number without those elements can mislead. The 2025 official notification is linked for that assessment.
Does an existing villa prove the hillside is safe?
No. Have a qualified professional assess relevant ground, retaining and drainage questions, and review the approval history separately. Occupation and appearance are not substitutes for those checks.
Sources & verification limits
Use these sources to trace the rules and services discussed. Translations and summaries help with reading; they do not replace the applicable Thai text or verification for the particular parcel.
- ONEP — Samui / Phangan environmental protection notification B.E. 2568
Official Gazette text, 21 May 2025, replacing the 2014 instrument and 2023 extension. Read the operative provisions, maps and any amendments with the competent authority; this guide does not certify a parcel's compliance.
- Department of Public Works and Town & Country Planning
Official planning and building service entrypoint. Obtain current local instruments and a parcel-specific response; an older online map may not identify all operative requirements.
- Thai Senate Legal Bureau — servitude and necessary way
Official distinction between access mechanisms. A route's enforceability and permitted uses require examination of the relevant rights and facts.
